1. Agreement to Terms

By accessing or using the AVERS platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Services.

2. Use of Services

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Services in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any portion of the Services
• Interfere with or disrupt the Services or servers
• Use automated systems to access the Services without permission
• Transmit any malicious code or harmful materials

3. Account Registration

To access certain features of the Services, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for any activities or actions under your account.

4. Intellectual Property

The Services and their entire contents, features, and functionality are owned by AVERS and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

5. Service Level Agreement

We strive to maintain 99.9% uptime for our Services. However, we do not guarantee uninterrupted access and may suspend Services for maintenance, updates, or unforeseen circumstances. We will provide advance notice of scheduled maintenance when possible.

6. Payment Terms

Fees for Services are based on your subscription plan. All fees are non-refundable except as required by law. We reserve the right to change our fees with 30 days' notice. Failure to pay fees may result in suspension or termination of Services.

7. Limitation of Liability

To the maximum extent permitted by law, AVERS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

8. Termination

We may terminate or suspend your account and access to Services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Services will immediately cease.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Bangkok, Thailand.
